1 - Overview
Section titled “1 - Overview”These Terms of Use (“Terms”) govern your access to and use of Elecplanner (elecplanner.com). By using Elecplanner, you agree to these Terms. If you do not agree, do not use the service. Elecplanner is currently operated by an individual developer residing in France. There is no registered company yet.
2 - Service description
Section titled “2 - Service description”Elecplanner is a virtual environment for designing and simulating electrical installations. Users can drag and drop components (e.g., panels, circuit breakers, lights, switches, outlets), connect them, and run simulations. Elecplanner does not guarantee real-world equivalence of results and is provided for educational and planning purposes only.
3 - No professional advice; safety warning
Section titled “3 - No professional advice; safety warning”- Elecplanner is not a substitute for professional advice, training, or certification in electrical work.
- Electricity is dangerous. Real-world electrical work must comply with applicable laws, codes, and standards. If you have any doubt, consult or hire a qualified, licensed electrician.
- You are solely responsible for any real-life implementation based on Elecplanner. Always verify designs with a professional and follow safety protocols.
4 - Eligibility
Section titled “4 - Eligibility”You must be able to form a binding contract under applicable law. If you are using Elecplanner on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
5 - Accounts
Section titled “5 - Accounts”Currently, Elecplanner does not require user accounts. If accounts are introduced later, additional terms and privacy updates will apply.
6 - Acceptable use
Section titled “6 - Acceptable use”You agree not to:
- Use Elecplanner for unlawful, unsafe, or harmful purposes.
- Circumvent or attempt to circumvent security or technical safeguards.
- Reverse engineer, decompile, or otherwise attempt to derive source code, except as permitted by law.
- Interfere with or disrupt the service or its infrastructure.
- Infringe intellectual property or other rights.
- Upload malicious code or content.
- Misrepresent simulations as guaranteed real-world outcomes.
7 - Intellectual property
Section titled “7 - Intellectual property”- Elecplanner software, design, logos, and content are owned by the operator and/or licensors and protected by applicable intellectual property laws. -You retain rights in your own designs and inputs created using Elecplanner. By submitting content to the service, you grant us a non-exclusive, worldwide, royalty-free license to use, host, reproduce, and display that content as necessary to operate and improve the service.
- Do not use Elecplanner marks or content without prior written permission.
8 - Third-party services
Section titled “8 - Third-party services”Elecplanner may integrate third-party tools (e.g., Google Analytics, HubSpot). Your use of these tools is subject to their terms and privacy policies. We are not responsible for third-party services.
9 - Disclaimers
Section titled “9 - Disclaimers”- Elecplanner is provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to accuracy, reliability, fitness for a particular purpose, and non-infringement.
- Simulations are approximate and for informational purposes only. They may contain errors or omissions and may not reflect real-world behavior, constraints, or regulatory requirements.
- We do not warrant that Elecplanner will be uninterrupted, secure, or error-free.
10 - Limitation of liability
Section titled “10 - Limitation of liability”To the maximum extent permitted by law:
- We will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, or other intangible losses.
- Our total liability for any claim arising out of or relating to the service shall not exceed the greater of: (a) €50, or (b) the amount you paid (if any) to use Elecplanner in the 12 months preceding the claim.
- Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
11 - Indemnification
Section titled “11 - Indemnification”You agree to indemnify and hold harmless the operator and its affiliates, contractors, and licensors from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of Elecplanner, your content, or your violation of these Terms or applicable law, including any real-life implementation of designs.
12 - Changes to the service
Section titled “12 - Changes to the service”We may modify, suspend, or discontinue Elecplanner or any part thereof at any time without liability. We may also change these Terms. Continued use after changes constitutes acceptance. For material changes, we may provide additional notice.
13 - Termination
Section titled “13 - Termination”We may suspend or terminate your access at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, sections that by their nature should survive will survive (e.g., IP, disclaimers, limitations of liability, indemnity).
14 - Governing law and jurisdiction
Section titled “14 - Governing law and jurisdiction”These Terms are governed by French law, without regard to its conflict-of-law principles. If you are a consumer in the EU, you may benefit from mandatory local consumer protections. The courts of Paris (France) shall have jurisdiction, unless mandatory law provides otherwise.
15 - Export and sanctions compliance
Section titled “15 - Export and sanctions compliance”You represent that you are not subject to EU, UK, or US sanctions and will not use Elecplanner in violation of applicable export control and sanctions laws.
